Terms & Conditions

Effective date: September 24, 2026

About These Terms

These Terms and Conditions ("Terms") govern your use of highnotescale.ai (the "Site"), operated by HighNote Performance Coaching ("HighNote", "we", "us" or "our"), 102 Bloor St W, Toronto, Ontario M5S 1M8, Canada. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Our Services

The Site provides information about HighNote's leadership development programs, including workshops, immersive experiences, one-to-one coaching and AI-supported communication analysis. Information on the Site is not an offer capable of acceptance. All coaching and program engagements are delivered under a separate written agreement, proposal or statement of work (a "Client Agreement"). Where a Client Agreement conflicts with these Terms, the Client Agreement governs.

Eligibility

You must be at least the age of majority in your province, territory or country of residence to submit information through the Site. If you submit information on behalf of an organization, you confirm that you are authorized to do so.

Inquiries, Demos and Consultations

When you submit a contact form, request a demo or book a consultation, you agree to provide accurate and current information. Submitting an inquiry does not create a client relationship, and we may decline any request at our discretion.

AI-Supported Analysis

Some HighNote programs use AI analysis, provided through our technology partner, to identify patterns in voice, pacing, emotion and non-verbal communication. AI output is a developmental tool that supports the judgment of our coaches and never replaces it. It is not a psychological, medical, clinical or employment assessment and must not be used as the sole basis for hiring, promotion, compensation or disciplinary decisions. Recording and analysis take place only with the participant's consent, as described in our Privacy Policy and the applicable Client Agreement.

Intellectual Property

All content on the Site, including text, graphics, logos, the HighNote name and marks, program names, methodologies, videos and images, is owned by or licensed to HighNote and is protected by Canadian and international intellectual property laws. You may view and print content for your personal, non-commercial use or for your organization's internal evaluation of our services. You may not copy, reproduce, modify, distribute, republish or create derivative works from any content without our prior written consent.

Acceptable Use

You agree not to:

  • use the Site in any way that violates applicable law;

  • attempt to gain unauthorized access to the Site, its systems or its data;

  • introduce viruses, malicious code or anything that interferes with the Site's operation;

  • scrape, harvest or collect content or data from the Site by automated means; or

  • misrepresent your identity or your affiliation with any person or organization.

Limitation of Liability

To the fullest extent permitted by law, HighNote and its founders, coaches, partners and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of or inability to use the Site. Our total liability for any claim relating to the Site is limited to one hundred Canadian dollars (CAD $100). Liability for paid engagements is governed by the applicable Client Agreement.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario.

General
